Divorce 101: Maintenance Pending Suit - England & Wales (#36)

Either party may apply for an interim financial order, known as an order for maintenance pending suit, at any time before the court issues a final financial order.  For example, where they are struggling to meet immediate expenses without the others support.

Section 22 of the Marital Causes Act 1973 states as follows:

"On a petition for divorce ... the court may make an order for maintenance pending suit, that is to say, an order requiring either party to the marriage to make to the other ... periodical payments for his or her maintenance ... for ... a term beginning not earlier than the date of the presentation of the petition and ending with the date of the determination of the suit, as the court thinks reasonable."
